According to a report by the Financial Times, these digital influencers are now making up a significant portion of the applicants for this specialized visa.
The O-1B visa program was established to recognize individuals demonstrating exceptional ability in the arts or extraordinary achievement in the motion picture and television industries. It also covers achievements in sciences, education, business, or athletics. However, recent years have seen a shift in the type of talent being recognized, with immigration attorneys reporting that influencers now comprise about half of their total client base.
These changes are largely due to the quantifiable nature of social media success metrics, such as follower counts and engagement numbers, which provide clear evidence for visa application approvals. Immigration lawyer Elektra Yao pointed out that large follower numbers are impressive to the general public, which simplifies the evaluation process for visa adjudicators.
Statistical data shows that the number of O-1B visas granted has risen by more than 50 percent between 2014 and 2024, a stark contrast to the 10 percent growth of non-immigration visas overall. In 2024 alone, approximately 20,000 O-1B visas were issued, granting temporary work authorization to individuals with exceptional talents.
The shift in the O-1B visa demographic is illustrated by the experience of immigration lawyer Jacob Sapochnick, who shared his initial skepticism when approached by an OnlyFans client. His perspective changed upon reviewing the client's substantial earnings of $250,000 monthly, which he saw as compelling evidence for the visa application. This case exemplifies the changing criteria for what constitutes "extraordinary ability" in the digital era.
However, some immigration lawyers express concerns about the standards of approval. Protima Daryanani, an immigration attorney, voiced worries that the spirit of the extraordinary ability requirement might be compromised, as applicants are being approved by merely meeting basic categorical standards.
This evolution of the O-1B visa category reflects the broader conversation about the recognition of digital talent and the changing face of the arts and entertainment industries. While the program continues to serve traditional artists, it now also caters to a new demographic that dominates the digital realm.
