New York Attorney General Letitia James is currently under the legal spotlight as she faces a bar complaint following the dismissal of federal mortgage fraud charges against her. The complaint, filed by the right-leaning Center to Advance Security in America (CASA), requests an immediate investigation by the Attorney Grievance Committee, which oversees legal conduct in Manhattan and the Bronx.
CASA's director of research and policy, Curtis Schube, emphasized the importance of integrity, stating that "fraud, misrepresentation, honesty, and trustworthiness are all factors" that warrant disciplinary action against an attorney. This move comes in the wake of Senior U.S. District Judge Cameron Currie's decision on Monday to dismiss the charges against James, citing that the special attorney who prosecuted, Lindsey Halligan, lacked the necessary authority to do so.
Halligan, who was not confirmed by Congress or any judicial panel, had alleged that James falsified documents to obtain a $109,600 loan for a property in Norfolk, Virginia. The property, claimed by James as her primary residence, was reportedly occupied by her grandniece. If the charges were proven, the fraudulent loan would have resulted in an extra $19,000 over its lifetime.
The case has captured national attention given James' prominent role. Her ethics filings from 2020 to 2023 showed the Norfolk home as an "investment property," which she later reclassified as "real property" in 2024, reporting it generated no income. This change followed a referral from Federal Housing Finance Agency Director Bill Pulte to the Department of Justice (DOJ), prompting scrutiny over James' transparency.
Attorney General Pam Bondi, representing the DOJ under President Trump, has expressed the intention to explore all legal avenues, including an appeal, to ensure accountability for James' actions. With a potential conviction, James could face up to 60 years in prison and $2 million in fines. Her response to the dismissed charges was one of triumph, as she thanked her supporters and maintained her dedication to serving New Yorkers.
